Legal Compliance meets Business Benefits
With the adoption of the EU Ecodesign for Sustainable Products Regulation (ESPR) in June 2024, accompanied by its Delegated Acts on Textiles (focusing on apparel) and Steel, the EU Parliament and Council have initiated a transformative step towards more sustainable products and business practices. Starting in early 2027, these regulations will require compliance from companies selling their products on the EU market. A cornerstone of this initiative is the enforcement of Digital Product Passports (DPPs), which will serve as standardized electronic "containers" for all relevant product data.
The initial Delegated Acts are set to be followed by additional regulations targeting a broader range of products. It can be anticipated that these will start with Furniture, Mattresses, Consumer electronics, Photovoltaics (PV), and Tyres. Ultimately, almost all products on the EU market are foreseen to be covered (with exceptions for products such as medical, food&drinks and defence, only). Simultaneously, the EU has already enacted the new Batteries Regulation and the revised Construction Products Regulation (CPR), both of which mandate interoperable DPPs for all products within their scope, as part of the CE mark, requiring compliance from early 2027 onwards. The European Commission will implement the requirements on construction products incrementally through Delegated Acts, product category by product category.
Looking ahead, additional policies, both newly introduced and revised, are expected to include DPP requirements. Examples include the revised Toys Safety Directive, the revised Packaging and Packaging Waste Regulation, and the new Green Claims Directive for all kinds of Consumer Products.
The technical framework - including system architecture, DPP scope, and interoperability requirements - is being developed through a series of horizontal and product-specific harmonised standards mandated under the ESPR and CPR. Dedicated projects are complementing the ongoing standards developments. Similar initiatives are also gaining momentum in South Korea, China, and the UK, signaling a global trend toward harmonized sustainable product regulations - operationalised via DPPs.
To ensure compliance, we strongly recommend that affected companies — including manufacturers but also retailers — identify and start implementing DPP solutions at least 12 months before the mandatory operational deadlines. Additionally, all DPPs must be registered with the centralized EU registry. Companies should however ensure that their chosen solutions not only support compliance with applicable policies but also enable customization of DPPs to meet specific product and company needs. Effective solutions should assist you in preparing and filling data and information, including from upstream supply networks what is required and the most challenging part. Preventing provider lock-in, safeguarding business-sensitive information, ensuring robust data security, and establishing efficient workflows are equally pivotal. These and a couple of further considerations are essential to navigate the complexity of the requirements and effectively and efficiently manage data-access "at scale" from global supply networks.
